Alright guys, well as all of you know I recently signed the lease on a shop and moved in Monday. As of this morning I have til friday morning to vacate the premises. They are evicting me due to "Complaints of loud noise and excessive people." They gave me my 6 months rent back and said I have til saturday morning when they change the locks.
Basically, the realty agent called me this morning asking for me to stop by the realty office. I get to Evans Realty and he says that I need to move out because of all the complaints they have been getting. The owner of the building has chewed them up and down the wall because of the "loud exhausts and teenagers." He also said he didn't know I was going to be building a "racecar." He thought I was just going to use it as storage. No where in the lease does it say I can not build a "race car" or anything of the nature. It says nothing of what I can not do basically. I will upload it and post it if you all would like.
Later on in the day, I call him and ask what exactly did I violate in the lease. He said that the owner just doesn't want that kinda thing going on there. Its a nice business estabilshment. So I ask if I can meet with this owner. Well the owner is Jeff Evans. The son of the person who owns Evans Realty. He said he will meet with me but will not change his mind. He wants me out by saturday and the locks will be changed that morning. I have violated NOTHING in the lease. The agent knew I was working on cars there. He stopped by to deliver some paperwork the day after I moved in. All he said then was, "We just don't want any trashy cars out here in the parking lot." I AM SOOO PISSED. I have a call into the Real Estate Commission. I will be meeting with them tomorrow morning. Out of everyone I have talked to including the owner of Century 21 in Prattville, they all say there is no leg to stand on to evict me. The first months rent is not even due yet. He gave me back the 6 months rent already. What it comes down to is that they just don't want me there, which is just bullshit. They can not evict me, just cuz they feel like it. :bfg: This is really fucking aggrevating. The main thing that pisses me off is that he wants me to be out by saturday, which is not possible, they are being total dicks about nothing, and its all because they think I am just a pesky "teenager." I need to find another shop so I can just move all my shit into there and not have to worry about moving twice. Any advice on where to begin looking would be greatly appreciated. Sean is there anything near you, in that complex?

Wow that sucks. Did you tell them everybody was there to help you move in, we aren't all going to all be there all the time. They can't freaking just kick you out because there were people with loud exhausts, or because they don't like cars. You did NOTHING illegal and NOTHING to violate the lease. Sue.
All he said then was, "We just don't want any trashy cars out here in the parking lot." Discrimination. You can build a nice car with the money you get.

that's complete bullshit, and im sure you are right about them just kicking you out because of your age and what you do. Fuckers - I hope you become famous in the industry in which you pursue, so you can rub it in their face and buy the entire complex or business right out from under them.
I also think aspeed should do a driveby during every meet just to piss off whoever complained, with open exhaust around the garage

Does it say in the lease that they can evict you whenever they want for whatever they want?
Dont they have to give you 30 days notice as well?
My business law teacher is lawyer, I can get him to look at the lease if ya want. Good luck man.

This is the brillance that got him in trouble in the first place.
Walk into their office tomorrow and ask them to point to the exact clause in the lease that they are exercising that allows them to breach the contract. I have a few good friends in real estate I'd be happy to have them contact you.
Basically if the lease is signed and done then they must abide by the lease. You can sue them for breech of contract. Briefly go through your head what this space is worth to you (i.e. what fiscal harm, if any they are causing you by breaking the lease: your cost of moving, time invested already in moving in; these are things you could possibly sue for). Hey... You could wind up with some cash here.
I hope Evans doesn't also handle your residential lease, that could case you some problems :D

Hell no! That's total BS! We did nothing wrong at all and we weren't even that loud. Maybe a few saws and some hammers and people talking. But what the hell do people expect. Whoever the hell called in the complaints is obviously stereotyping the "car crowd". Those fuckers have nothing on you and you did nothing wrong. I'm sorry man. Even though you did take the money back already, I'd sue them for breach of contract. At least get some cash outta the fuckers.
On the bright side, better it happen now than in a month or two when you came up with a solution to the shower, internet installed, and other stuff like that.

CAUTION: be careful with this...Aubrn is a SMALL town and most everybody knows everybody else....just tread lightly at first to not piss off another person.

On Bragg Ave, headed toward donahue on the right is a nice looking shop type building...I just remember see a for rent sign on it & I believe it was first realty.....check it out yo.

Realty co's in auburn are run by a bunch of crooks anyway. I had issues with the last major realty company i leased with (first), they'd leave nastygrams on your door for things they didnt like to see, but if something broke in the appartment, good luck....

The Evans are the biggest bunch of assholes. Right behind the Northcutts. Be aware that Mr. Evans is on the Board of Directors of AuburnBank. If I am not mistaken one of the Evan's boys wife has a dance/gymnastics studio on the same side of the Stage Road just down from your shop space.
Reality companies in Auburn are about a quarter step above rapist and child molesters in my book.
They really have no legal reason to kick you out, other than they do not want you there because you "work on cars".
Good Luck with this, but I would be looking for some other space in town. One not owned/leased by Evans Reality.

Jeff Evans is the Evans boy that does own my building. That explains a lot. She must have been the one "complaining"

i hardly glanced at my lease when we signed for this appartment, not realizing that by doing so i relieved them of any liability they had for the condition of this appartment when we moved in.
There were cum stains on my wall when i moved in and my realty company shrugged and said, "sorry, nothing we can do!" I nearly called our lawyer and it turned into a big ordeal.

There were cum stains on my wall when i moved in and my realty company shrugged and said, "sorry, nothing we can do!" I nearly called our lawyer and it turned into a big ordeal.

:O eventually, they came out and cleaned/painted my room once they realized that the cost of paint and a couple hours of labor was much cheaper than lawyer fees. it went on for nearly a month before they came out though, it was such a hassle. :( Its worth it to spend an a couple hours and read all that! its worth the patience
